RASULULLAH S.A.W AND emancipation of women
Various aspects of the life of the Prophet Muhammad. is perfect, so anyone who chooses to write about it will be stunned and very difficult to choose this topic. Taking into account the needs of the present, however, I hope to elevate the life of the Prophet Muhammad., On his way to rid the world of slavery outright, which is the bane of humanity. I mean here is, the enslavement of women.
Before the arrival of the Prophet Muhammad., All women in all parts of the world are in a position as a slave and is considered as goods that can be possessed, and the enslavement of their backfire even against men, in the case of a boy from a female slave does not have the same spirit of freedom.
No doubt, women, either because of her beauty or sparkling character, capable, in kasus2 individual, male dominated, but obtained the freedom not to be interpreted as true freedom, for the simple reason that women do not have the right to freedom. This is only an exception to the generally accepted rule, and the extraordinary true freedom, can be difficult for the real culture of aspiration.
Prophet., Came about 1,350 years ago (as of this writing. Transl). Before that, there was no religion or country in giving freedom to women as a right. Of course, in negara2 where there is no applicable law, women are free from any helplessness. Still, even this kind of freedom can not be said to be true freedom. More can be interpreted as a license. True freedom is emerging from civilization and in accordance with the law. The freedom that we get when we break the law is not freedom at all, because this kind of freedom do not produce strength of character.
II
At the time of the Prophet., And previously, the woman was placed in circumstances where he is not the owner of the property she had, her husband is considered as the owner of his property. Women do not have a part of his father's estate. He also can not inherit from her husband, although in some cases, he can manage the property during her husband was still alive. At the time was married, a woman is regarded as her husband's property, it is not possible to separate from him, or as an alternative, have the right to divorce her husband but she was not given the right to secede from her husband, however difficult problems he faced.
When her husband left her, ignoring its obligations to it, or run away from his wife, there are no laws that protect women. An obligation for women to accept the consequences, to work to support themselves and their children. The husband, has the right, this is out of the problem of high temperament, to beat his wife, and his wife should not even raise your voice against it. If the husband dies, the wife, in some countries, given to relatives of the husband, who can marry, or to whomever they want, either as a donation or remuneration from profits earned. In some places, on the other hand, women are considered the property of her husband. Some will sell her husband when they lost the gamble, and when they do that, they assume it is the right of the husband.
A woman does not have the rights to his children well in her position as a wife, nor in a position he did not depend on her husband. In domestic affairs he did not have the privilege. Even in religion he does not have a status. In sipiritual bond-even women do not have the parts. As a consequence, the husband used to scatter treasure their wives and leave them without giving the slightest for his purposes. The wife, can not, even if it is their own property, giving a donation or to help relatives, without the consent of her husband, and the husband who greedy will not give permission for it.
Regarding the property of the parents of a woman, where there is a deep bond of affection, wanitapun not have a section. And daughters have the same rights to his parents as a boy. Parents who have a sense of justice, during his life would give part of his property to their daughters, and leaving only to feed their families. This is not true for boys, because after the death of a parent, they will inherit the entire property (and therefore should not be allowed to object to their sisters receive gifts from their parents); into consideration they are, their sisters at that time had more of them.
Regarding her husband's property, where a wife has a total relationship, women also do not have the right. Distant relatives of the husband can ask for part, but not a wife. A wife, in fact, is the self-esteem of people who keep a husband, a spouse, the devotion and affection would greatly contribute to the income of a husband. On the other hand, when a wife managing her husband's property, he does not have the right and the slightest part of the property. If a wife can spend the income from such property, he still should not be set parts. In regard to charity, therefore, he was not allowed to decide as he wishes.
If the husband's cruel to his wife, he can not be separated from her husband. In societies where the separation is possible, is the condition in which self-respecting woman who chose death as a way of farewell. For example, a separation must provide proof of fault of either party, as well as evidence of mistreatment of her husband. Worse, in such cases, where the wife is no longer possible to live with her husband, she still can not be separated from her husband, but he was only allowed to stay apart, which is a form of torture as well, because then he was forced to live a life that is empty and has no purpose.
In some cases occur where the husband can divorce his wife whenever he likes, while the wife is not possible to ask for a divorce. If a husband and wife leave, or leave the country without giving allowance, the wife is obliged to remain through life without the right to devote himself to the state or society. Marriage, instead of giving a happiness, instead become a life full of suffering for a wife. Wife obligation not only obligations and her husband, but he was also obliged to wait for her husband. Husband obligation, call to meet the needs of the household into the wife's responsibility, not to mention its own duty to care for and raise their children. Mental burden on the one hand, and the obligation to provide the material on the other side.
All this, in short, was tolerated in cases involving the poor creature and not protected. Battered women, and regarded as the husband property. When the husband dies, his widow is forced to marry a relative of her husband or sold for money. In fact, the husband himself also sells his wife. Prince of Indians as Panawas lost their wives at the gambling table and for the unlawful possession of land, valued as a Princess Draupadi, can not be the slightest sound.
In terms of the education of children, mothers are invited to discuss and they do not have the rights to their children. If mom and dad split up, children handed over to the father. Women do not have any rights to the household. Whenever husband wants, he can throw his wife out of the house and up must be stranded without shelter.
III
The arrival of the Prophet. eliminated all this outrage with one sweep. He stated that God has entrusted to him the task to safeguard the rights of women.
He stated the name of God that as men and women are the same, and by the time they lived together, as men have certain rights to women, and vice versa, women have certain rights to men. Women may have a right to his property as men. A husband has no right to use his property, for the wife, by his own will, did not give permission. Forced to take his property, or where women are shy to show his refusal, is wrong. Whatever is given by the husband with sincerity, will be the right of the wife and the husband should not take it anymore. He is also entitled to inherit from her parents as her brother. However, given that the obligation to bear the family is in men, and women are considered only need to bear himself, then the part is half of the men's section, the entire property of their parents died.
Similarly, a mother is also entitled to inherit from her son who died as well as the father of the boy. But given the situation he berbeda2 and responsibilities entailed in certain cases, the same parts can be also less than a part of his father. When her husband died the wife is entitled to the inheritance, whether it has or does not have children, because he was considered not depend on other things.
Marriage (already considered common) is, without doubt, is a sacred bond, which, after a married couple enjoying the deepest intimacy, so that separation of husband and wife is a hated thing. However, as bad as any difference between duabelah party, in matters of religion, physical, economic, social or mental, they must have a strong commitment to maintaining the integrity of their marriage, and should not destroy their lives and destroy the purpose of their existence.
If this difference arises, and husband and wife agreed that they can not live together, they (have taught) can - by mutual consent - an end to togetherness. However, if only the husband and wife have this view do not, and they failed to adjust themselves to one another, this matter should be helped by two people Hakam, the one representing the husband and wife are one represents. If this Hakam decided that both sides must strive to live together, then each party should try to resolve the problem in accordance with the recommendation Hakam. If an agreement can not be reached, the husband can divorce his wife, but in this case, he has no right to take back anything he had (before the divorce) gave to his wife, including the entire dowry (mahr).
If on the other hand, a wife who wants separation and not the husband, the wife should submit an application to the judge, and if the judge was convinced that there was no bad motive of the request, the judge may decide separation. Only in certain cases the wife must return to her husband, the treasure that has been given to him, including the bride price / dowry. If the husband fails to meet its obligations in marriage, or do not want to talk again with his wife or he asked his wife to separate beds, it should not exceed a certain time limit. Within four months after the treatment he must declare whether to maintain the marriage or divorce his wife.
If the husband to his wife to stop living or leave it, or no longer take care of his wife, the marriage can be canceled. (Three years has been set as the limit wife left by the Muslim judge). The wife then free to marry again.
The husband must be responsible for the maintenance of his wife and children. He may only reasonable discipline, but if for this discipline had to do, he should have sufficient witnesses and reveals the error of his wife and basing his judgment on the evidence. Punishment should not leave persistent disability.
A husband does not "own" his wife as property. He should not sell it, or force in domestic work. Wife shared all things in the household, and treatment of husband to wife will indicate the position where it is located. A treatment that is lower than it should be done by a man with husband's status is not true.
At the time of her death, her family did not have the right to wife. The wife may be free and if there is a chance that he has a right to marry again. No person may stop him. A widow also not be placed in a certain place. He may live in her husband's house for four months and ten days until all the right of the wife and her family have the right is arranged.
A year after the death of her husband is a widow, whatever happened to him, is entitled to use her husband's house, so he can use what is left to his needs and he has a place to stay.
Quarreled with her husband when the husband who had to leave the house, and should not ask her to go out, because the house is rightfully his wife. In terms of maintenance of children, women have equal rights and obligations. He must be involved.
In the matter of children, women should not be ignored in any case. Regarding breastfeeding, parenting is dependent on the opinion. When husband and wife felt no longer possible to live together, and want to split, then parenting small children should be left to the mother. At the time adult children, for the purpose of education, the child may return to his father. During the children lived with her mother, then the maintenance should be provided by the father. Dad also had to pay time and effort spent in the care of the mother of his children.
In short, women have an independent status. Spiritual merit is also open for him. It also can achieve ultimate glory in the afterlife, and in the life of the world he can participate in a variety of public affairs. In this case he has the right to be treated equally with men.
IV
This is the teaching of the Prophet. distributed at the time of treatment standards throughout the world is the opposite. Through his orders, he was freed from the slavery of women who have become one with their lives for thousands of years, where they were forced to accept in various parts of the world, not to mention the pressure of various religions against women. A man in the future, remove the entire chain of this slavery! Bring freedom to the mother, and he at the same time freeing children from slavery sentiment and sow and nurture ambitions and high self-esteem.
However, the world does not appreciate the value of these teachings. What is considered an advantage labeled as tyranny. Divorce and separation are considered as a problem, a legacy considered destroying the family, the independence of a woman regarded as the destruction of domestic life. Over one thousand three hundred years, it continues to be practiced blindly, but what the Prophet is for the good of mankind. Continues with blasphemy against the doctrine that states that the doctrine contrary to human nature. Then came a time when the word of God (which is delivered through the apostles) then becomes real. People who consider themselves civilized, began to adhere to the teachings of the Prophet. Everyone, and then began to change their rules to conform to the teachings of the Prophet.
Legislation in the UK, which requires the existence of ill-treatment and arbitrary, and domestic violence that occurs in one of the parties as a condition of divorce, amended in 1923. Ill-treatment is sufficient to meet the requirements of divorce on the new legislation.
New Zealand decided, in 1912, that if an insane wife for seven years, the marriage can be canceled. In 1925, further stipulated that if the husband or wife can not fulfill their marital obligations, then they may be divorced or separated. If within three years of the husband and wife do not care for one another, then the divorce was dropped. A good imitation of Islamic law, of course, but only made after 1,300 years of attacks on Islam.
In the state of Australia, Queensland, insanity for five years, is considered sufficient as a reason for divorce. In Tasmania, a law enacted in 1919, which said that the ill-treatment, leave for four years, drunken habits, and pengacuhan for three years, to go to jail, beatings, lack warasan, should, either one or wholly fairly be grounds for divorce. In Victoria, legislation enacted in 1923 provides that if a husband does not take care of his wife for three years, or misconduct, or do not give a living, mistreat his wife, then divorce is possible. Further arranged that when entering prison, beatings, bad behavior on the part of the wife, insanity, abuse and constant bickering is grounds for divorce or separation.
In the western part of Australia, in addition to the laws that regulate the above, the marriage of a woman in a state containing also declared invalid or void (Islam also has the same view)
In Cuba, it was decided in 1918 that the bad behavior, beatings, berate, are in the police investigation, drunken habits, gambling habit, can not fulfill the obligation, does not provide for, infectious diseases or collective agreements, can be accepted as a condition of divorce or separation.
Italy declared in 1919 that women should have the right over his property. He can give it as a donation or sell it if he wants. (up to now in Europe, women are not treated as the owner of his property itself)
In Mexico as well, as the above condition is considered sufficient as a requirement for divorce. In addition, collective agreements are also considered to be sufficient. This law was enacted in 1917. Portugal enforces 1915, Norway in 1909, Sweden in 1920, and Switzerland in 1912 have enacted laws allowing divorce and separation. In Sweden, the law requires fathers to support the needs of his life up to the age of eighteen years.
In the United States even though the law requires to protect the rights of fathers to their children, but in practice, judges began to take into account the weakness of the mother, and the father is now obliged to provide for her son who lives with his mother. Of course there are many deficiencies in their law. Although the rights of men guarded, but women were also allowed to have a right to his property. At the same time, in many states, is set if the husband suffered permanent disability, then the wife should support the needs of her husband alive.
Women now have the right to choose, and the road has been open where they can give voice to the national interest. However, all this happened 1300 years after the Prophet. spreading his teachings. Many things are still waiting to happen. In some countries, women still do not have a part of the legacy of their parents or husbands. Likewise, in some other problems, Islam continues to provide guidance to the whole world, though the world has not recognized it.
